Terms of Use

  1. Introduction

  • Welcome to the lifestyle and wellness subscription site (hereinafter referred to as the Maip Design). The Site is owned and operated by Maip Design (hereinafter referred to as “we,” “us,” or “our”).
  • By accessing and using the Site, you agree to be bound by the following terms and conditions (hereinafter referred to as the “Terms of Use”). If you do not agree to these Terms of Use, please do not use the Site.

  1. Site Content

  • All of the information and materials on the Site, including, but not limited to, text, graphics, images, logos, and videos (hereinafter referred to as the “Content”), are protected by copyright and other intellectual property rights.
  • The Content is intended for your personal, non-commercial use, and you may download, print, or save a single copy for your personal use, provided you do not modify any of the Content in any way.
  • You may not use any of the Content for commercial purposes, or for any purpose that is unlawful or prohibited by these Terms of Use.

  • The Site may permit you to submit, upload, publish, or otherwise make available content, including but not limited to text, photographs, videos, and audio (hereinafter referred to as “User Content”).
  • By making any User Content available through the Site, you grant to us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Site and our business).
  • You represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents, releases, and clearances to grant us the rights granted in these Terms of Use; and (ii) neither the User Content, nor your submission, uploading, publishing, or otherwise making available of such User Content, nor our use of the User Content as permitted herein will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

  1. Proprietary Rights

  • The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by us, our licensors, or other providers of such material and are protected by Republic of South Africa and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
  • These Terms of Use permit you to use the Site for your personal, non-commercial use only. You hereby acknowledge that any unauthorized commercial use may violate applicable laws, including without limitation copyright and trademark laws.

  1. Disclaimers

  • The Site and the Content are provided on an “as is” basis, without warranties of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not guarantee that the Site will be error-free, secure, or that access to. You understand that you use the Site at your own risk.
  • We do not endorse, guarantee, or assume responsibility for any products or services advertised or offered by a third party through the Site or any hyperlinked website or service, and we will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services.

  • To the fullest extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, or other economic advantage, arising out of, or in connection with, the Site or the Content, whether based on contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
  • Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations and exclusions may not apply to you.

  • We reserve the right to modify these Terms of Use at any time, and such modifications shall be effective immediately upon posting on the Site. Your continued use of the Site following the posting of revised Terms of Use means that you accept and agree to the changes.

  1. Governing Law

  • These Terms of Use are governed by and construed in accordance with the laws of the Republic of South Africa, without giving effect to any principles of conflicts of law.
  • Any dispute arising from or relating to these Terms of Use, the Site, or the Content shall be resolved in the courts located in the Gauteng

  1. Entire Agreement

  • These Terms of Use, together with the Privacy Policy and any additional terms to which you agree when using particular elements of the Site, constitute the entire agreement between you and us with respect to the use of the Site.
  • If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
